By accessing or using GraveLink ("the Service") at gravelink.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
GraveLink provides a platform for creating and hosting digital memorial pages, which may be linked to physical QR/NFC markers. The Service includes account creation, memorial page creation and management, photo and video uploads, guest book functionality, and optional purchase of physical markers.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. GraveLink is not liable for any loss or damage arising from your failure to protect your account information.
You retain ownership of all content you upload to the Service ("User Content"). By uploading User Content, you grant GraveLink a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content solely for the purpose of providing the Service. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable laws.
You agree not to use the Service to upload, post, or transmit any content that is unlawful, defamatory, harassing, abusive, fraudulent, or otherwise objectionable; to impersonate any person or entity; to upload content that infringes on any intellectual property rights; to interfere with or disrupt the Service or its servers; or to attempt to gain unauthorized access to any part of the Service.
All paid plans are one-time purchases. Payments are processed securely by Stripe. All sales are final. We do not offer refunds except where required by applicable law or at our sole discretion in exceptional circumstances. If you believe you were charged in error, please contact us at [email protected] within 30 days of the transaction.
Physical markers included with Standard and Premium plans are shipped after purchase confirmation. GraveLink is not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control. Physical markers are non-returnable once shipped, except in cases of manufacturing defects.
GraveLink commits to hosting memorial pages for the lifetime of the Service. In the unlikely event that GraveLink ceases operations, we will provide at least 90 days' notice and offer users the ability to export their memorial content. GraveLink reserves the right to remove any memorial page that violates these Terms.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. GraveLink does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.
To the fullest extent permitted by law, GraveLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising out of or in connection with your use of the Service. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to GraveLink in the twelve months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
